Beyond the Law: The Bush Administration's Unlawful Responses in the "War" on Terror ReviewJordan Paust is Professor of International Law at the University of Houston's Law Center. He has produced a thorough and definitive account of US war crimes against its detainees.
50,000 people have been detained at Guantanamo Bay, at 25 sites in Afghanistan and 17 in Iraq. As Paust writes, "The `dirty war' would involve at least cruel and inhumane treatment of captured human beings and the forced disappearance of various detained persons, despite the fact that cruel and inhumane treatment and forced disappearance are well-known examples of conduct that is absolutely proscribed under several treaties of the United States and customary international law." The International Committee of the Red Cross described the US's interrogation process as `a form of torture'.
Presidential memos and directives illegally authorised illegal interrogation methods including at least cruel and inhumane treatment and the illegal secret detentions, renditions and disappearance of human beings. President Bush publicly admitted in September 2006 that he had approved `tough' interrogation tactics and a `program' of secret detentions and secret renditions, and that this would continue. Paust writes, "during the long history of the United States, no other President is known to have authorized violations of the laws of war concerning the transfer, treatment, and interrogation of human beings."
Government officials in most European countries, including Britain, are wrongfully complicit in violations of the rights of prisoners secretly detained in and/or transferred through their territory. They are obliged under international law not to be complicit in these violations.
Paust notes the Bush administration's "unprincipled plan to evade the reach of law and to take actions in violation of Geneva law while seeking to avoid criminal sanctions." He goes on, "The common plan and authorizations have criminal implications, as denials of protections under the laws of war are violations of the laws of war, which are war crimes." The illegal denial of combatant and POW status to members of Taliban armed forces provides a pretext for similar denials to US and other soldiers.
Bush's decision to call his post-9/11 policy a `war' on terror meets Al Qaeda's desires, because it upgrades terrorism to armed conflict and glorifies terrorists as warriors. It also makes the Pentagon a legitimate military target and gives Al Qaeda combatant immunity. The USA cannot be at `war' with bin Laden, Al Qaeda or `terrorism' because Al Qaeda is not a state or an insurgent, just a terrorist group. 9/11 was an armed attack, a crime against humanity, and the USA has only the right of selective and proportionate self-defence under the UN Charter against those directly involved.
Paust criticises `the Bush administration's unconstitutional and autocratic commander-above-the-law theory'. He writes, "The claim that the President has authority to violate international laws of war, human rights law, and domestic legislation is patently unconstitutional and unacceptable. Its nihilistic essence is remarkably close to the unlimited psychotic justifications of many terrorists ..."
Paust documents case law showing that presidents are bound by the laws of war and that presidential powers are subject to restraint by Congress, or should be. In fact, the rule of law appears to be ineffective, the separation of powers is not working, as President Bush rides over all judicial and congressional limits. He has claimed the authority to disobey more than 750 laws enacted since he took office.
He sums up, "war crimes policies and authorizations are not merely a threat to constitutional government and our democracy. They threaten law and order more generally, violate our common dignity, degrade our military, place our soldiers and CIA personnel in harm's way, thwart our mission, and deflate our authority and influence abroad. They can embolden an enemy, serve as a terrorist recruitment tool, lengthen social violence, and fulfill other terrorist ambitions." Control Freaks: 7 Ways Liberals Plan to Ruin Your Life ReviewThis is a perfect book for the times. Terrence Jeffrey clearly explains what Obama, Pelosi, and Reid are trying to accomplish and demonstrates why their policies, actions, and legislative tactics are against our Constitution, our heritage as a nation, and the will of the majority of Americans. (Of course, I hope we correct this in 2010 and 2012.)
Chapter One shows how Obama, our disgraceful transportation secretary Ray LaHood (a nominal Republican from Illinois) are using the force of government to manipulate markets to force us out of our cars and even our homes to live in the "high density" housing environments they preferred we would inhabit. You see, they are not about enabling us to fulfill our dreams and live in freedom and liberty, but as far as they are concerned we exist to allow them to fulfill their dreams and visions.
The second chapter focuses on the lies that were used to create social security and why it is collapsing today. Mr. Jeffry shows why would all be better off caring for our own retirement and how to do it than allowing the control freaks to keep ripping us off. And no, none of this is about breaking our promises to those in or near retirement. The rip offs have gone on from the beginning. Did you now that Ida May Fuller, the first recipient of social security, retired at 65 after paying a 1% tax on her $900 salary as a secretary. She had paid in $49.50 from 1937 until her retirement in 1939. By the time she died in she had collected payments from 1940 until 1975. By her third check she had recouped everything from her "trust fund" and when on to collect a total of $22,888.92 of other people's money.
We next explore the way our Federal Constitution has been tortured and ignored by Congress, abetted by "living Constitutionalists" in the judiciary to accomplish an expansion of government to intrude into every aspect of our lives. "Freedom, what freedom? We just want the illusion of security! No matter if we ruin the country as long as I get mine!" is what too many of seem to be saying with our votes and inattention to what our government is really doing to us. It cannot and won't go on, my friends. Not much longer, anyway.
I found the chapter on the perversion of "public use" into "public purpose" and an analysis of the "Kelo" decision by the Supreme Court to be most interesting and useful. I think you will to. This is a huge threat to our lives and property. Of course, the Left doesn't much like the idea of Private Property. To them, everything belongs to the state and they allocated it as the 535 demigods in Congress, the Chosen One in the White House, and the 9 great priests in the Supreme Court see fit. What was it the Declaration says about government existing to protect our natural rights and what we should do if the government fails to protect us in our rights?
The chapter on the way the Left strives to control political speech is exasperating and yet we know from what we see on the news and read in the paper that it is absolutely true. They act as if our Founders wrote the First Amendment to protect pornography rather than political speech. Another chapter on health care and our right to life is also a very important read. Obama pretends that the notion of when life begins is "above his pay grade" when he is a candidate, but when he is in office as a state legislator, a federal Senator or our President, no one is more pro-Abortion than he. Wait until some bureaucrat decides you aren't worth the healthcare sources they would have to allocate to treat you. Even if you have your own money, they will withhold it from you. We have to fight this, folks. Seriously fight it and repeal it.
Which leads us to the culture war the Left wants to fight while preventing the opposition (you and me) from resisting their efforts to "fundamentally transform" our culture and our nation.
An excellent book and you will find you can read it quickly while getting good information you can look up and verify if you want to.

The 5000 Year Leap (Original Authorized Edition) ReviewThis is an incredible book that should be read by all Americans.
I first read this book back in the mid 1980s shortly after it was first published. It had such a profound effect on me that I can still recall where I was when I was reading it. That is rather amazing as I have I have probably read about 1600 books since then.
I was excited to see that it had recently been republished as my original copy is pretty ragged. It was great to reread it and brush up on the great ideas contained in it.
The premise of the book is that because of the free market system that took root after our Constitution was enacted, the United States literally made a 5000 year leap of progress in the time since then. The author, W. Cleon Skousen, discussed the changes from the time of the founding of Jamestown in 1607 to the early 1980s when the book was written. In discussing Jamestown, he said: "The most striking thing about the settlers of Jamestown was their startling similarity to the ancient pioneers who built settlements in other parts of the world 5,000 years earlier. The whole panorama of Jamestown demonstrated how shockingly little progress had been made by man during all of those fifty centuries."
He went on to say, "The settlers of Jamestown had come in a boat no larger and no more commodious than those of the ancient sea kings. Their tools still consisted of shovel, axe, hoe, and a stick plow which were only slightly improved over those of China, Egypt, Persia, and Greece. They harvested their grain and hay-grass with the same primitive scythes ..."
He then discussed the Constitution that was developed by the Founders. It took 180 years for them to put it all together from the beginning of Jamestown in 1607 to the enactment of the U.S. Constitution in 1787. He goes through the inspirations and sources for their thoughts in explaining how the U.S. Constitutional system came about.
Dr. Skousen contrasted the situation described in Jamestown above to the present day. He talks about the phenomenol results produced by the free enterprise system. Some of the incredible inventions and changes that he cites are as follows: the internal combustion engine, jet propulsion, exotic space travel, 'all the wonders of nuclear energy', massive changes in communications, the doubling of the life expectancy, central heating/air conditioning, surgical miracles, cures for numerous diseases, etc. Needless to say, the list could go on and on.
In showing how our system was designed, Skousen goes through 28 principles that the Founders developed from their study of sources such as Cicero, Locke, Montesquieu, Adam Smith, and others. Skousen has done what most people don't have the time or inclination to do: Study the original source materials and bring it all together.
Obviously, it would be great if every American studied the sources listed above as well as The Federalist Papers, the writings of Jefferson, Franklin, Madison, and others. Since that is unlikely, this is a great way to gain a good general understanding of the roots of our nation.
One great thing about this book is that the author discusses some of the problems that we have faced in recent years due to failing to follow the Constitution and the principles of the Founders. Some of these are issues like the mounting national debt, excessive taxation, and judicial activism.
Dr. Skousen also does a great job of explaining the political spectrum and the absurdities of the left-right labeling so often used in discourse today. He explains in an easy-to-understand manner that the far left and far right as the terms are used today are really the same thing, ruler's law, and are totally out of step with the way the system was intended.
One could easily go on about this book for a long time, but I will spare the reader that. Suffice it to say, this is an amazing book that should be read by all.
I would also highly recommend, "The Making Of America" The Making of America: The Substance and Meaning of the Constitution by the same author. Anyone who reads those two books will know more about the way our system was designed and supposed to work than 99% of all Americans including 'constitutional lawyers'.
